I had a friend who was starting out his business get a cease and desist letter for his product. The proof he offered was wood working books showing how to do kerf cuts as that was the basic premise for the products. Since then he has gone on to be extremely successful and is selling that business. It was a ploy to try and stifle competition so just hang tight and get your ducks in a row. Should be easy to defend your position.

Whats next? going to patent the placement of wireless charging pads? the placement of rfid scanners? the shape of a poker table?

This all reminds me of the american company who took "ownership" of the word UGG for their sheepskin slippers and was sueing all the other Australian companies for using the word UGG, when UGG is synonymous in Australia for ugly sheep skin slippers. lol.

Patent for Placement of Cylinder Holding Containers with the Rail of a Poker or Gaming table (Patent # 10,783,494)

Patent for Attachment via Retaining Bracket to Gaming Table Surface for Purpose of On Table Storage (Patent 11,272,045)

Please bear in mind that many of patents filed are filed to avoid patent trolls patenting it and requesting a license fee from the inventor(!). In order to hold a valid patent you have to actively pursue it, i.e. send C&D to infringing partners.
The problem is that small operators doesn't have the capacity to pursue this, so they hire/outsource a patent company to do it and they don't know/care if it's frivolous or not. And they don't report what cases or vendors they approached, they just tell you "Hey we stopped 3 others from copying your patent last 6 months".
So no need to light up the torches yet, we don't know if this is intentional from Gorilla or not.

Regardless, the claim seems moot but you need a lawyer to answer and not roll over dead.

On the bright side, technology is always changing and those USB ports will probably be obsolete in favor of usb-c or wireless charging in a few years. Maybe Tony you could patent wireless flat chargers embedded in the padded rail? Or drink carts with chargers built in?
 
I'm not a lawyer, but I honestly wouldn't even hesitate to respond with a letter that tells them to get lost. You can't possibly patent the use of USB chargers in probably just about anything. That's laughable. You can put them in cars, in electrical outlets, in TV monitors, hell you can put them in toasters. No way you can protect against someone putting them in tables. Half the casinos across the country would be in violation of his "patent". Hell, my night stands would be in violation of his patent.

Like I said, it might as well be to prevent someone hitting you with a C&D.
For instance, when Nokia phones were the nuts, they came up with a lot of new innovations, like the T9 keyboard that they shared openly with everyone to use, free of charge/licenses. That came to an abrupt halt when Motorola started patenting Nokia's inventions and requested licenses from Nokia on those functions.
 
Was the Gorilla Gaming section on PCF always blank or was everything removed? I swear there were threads in there before.

That was my first thought. It surprised me to see the other party is (was?) a vendor here, and it was someone that Chanman has purchased materials from in the past.

That's why those Motorola patents are shit - they patented something that was already known and they did not invent. There are many issued patents that are substantively worthless and invalid (prior art, obvious to try). Orenstein's hole card camera patent is legit. This one is pure horseshit. Patent Office could issue an ass to mouth method patent, but it won't get you paid. R
 
This was brought to our attention and yes, we do own the rights to integrated USB charging integrated into the perimeter of gaming tables, this is something we put together and designed well before there was charging on/under/or in tables. We have both the utility and design patent and this table is a signature table of ours that has become a staple in the poker community and is the official poker table of the WSOP. This is important to us and our business so we of course wanted to protect that before others started to copy us. Patents are also a very standard practice in business.

There are ways to have USB charging that do not infringe on our patent and copy our table. For example, the sit n charge system or just screwing ports to the bottom doesn't infringe on what we do, but as Tony mentioned here, it is not as good.

As mentioned in the letter, the purpose of the letter was to make him aware of this and also start a dialogue with Tony, in private, on coming up with a solution that we can work together and probably even help him improve what he is doing with our kits. We have always respected his work, and him, and are happy to open a dialogue as was mentioned.

I am probably commenting more than I should publicly.

Please explain the patent on the basic poker table design? WTF is up with that. That design has been around forever.

The discussion in private needed to happen before you actually send him that kind of a letter. Slimy and distasteful of you to do. Now you want to sound like the good guy in public? What a despicable way to behave. We're grown men and shouldn't succumb to recent ways of sending legal letters. Pick up the phone like a damn gentleman that you claim you are and talk to the man. He's not some enormous Chinese factory trying to copy your stuff and just milk the profits out of it. He's a privately owned business that uses his immense talent to make a living. Grow up and try to get that in your head. I'm never buying anything from you even if they're the best product on the planet and I'll also make everybody who intends on buying products like yours aware of what you do so they can avoid buying your product as well.

There are certainly a lot of people in this community who have no respect for intellectual property law, so this attitude isn’t shocking.
I’d never take sides on this, mostly because it’s none of my business. But I’ve done business with @GorillaGlenn and I’ve enjoyed @T_Chan ’s contributions to this forum for years, so I appreciate both of them. All I’ll say is that in my opinion, people should put down their torches, mind their own business, and let these guys mind theirs.
