What's missing here? (1 Viewer)

I personally know of someone charged with this in the last year. “Running an illegal gaming operation.” It was legitimately illegal.
What was described above is not at all how the situation I personally know of went down.
Will leave it at that and I hope our member here recovers what was TAKEN from him.

Unfortunately, civil forfeiture laws allow law enforcement to seize cash and property, presuming it is connected to criminal activity, without probable cause or reasonable suspicion. Much of the proceeds benefit the department that seized it. If OP is found innocent, he’ll get the cash back, maybe his chips, guns, etc., but it will cost him thousands. It’s a racket, for sure.

The person I know in Virginia who was charged didn’t go through what was described here.
I understand what your saying about the forfeiture laws.
Sometimes things just don’t make sense to me.

Correct, but the question is what deemed this home game to be connected with criminal activity. There MUST be something else to the story that we aren't made aware of.

We use home daycare and it was down to just our kid at one point. This lady's daughter was going through an ugly divorce and one day a cop shows up to investigate whether or not she was licensed. (She had previously run a larger daycare out of home.)

To this day, I am not convinced that was a real cop, but maybe someone the ex son-in-law sent as a poser as a form of harassment.

No you are right. I can see my comment being a little presumptuous, and don't mean to come off as naive. It's just concerning to me as I host games, and I want preventative details. You know?
 
Damn.... Hate to hear this happen, but it has to be some sort of setup by someone who's been in your game or knows about you game. Probably someone narc'd you/your game out to the authorities to try and save their own ass.

Hope your family can manage to put that kind of trauma behind them, nothing worse than staring down the barrel of a gun in a situation like that. :(

What happened to the person I know of that was busted is the police were tipped off by one of her competitors.
That is the word to my understanding.
Lots of competition in the underground raked poker scene.
Multiple games on the same nights in many occasions.

Okay so @brains613 game isn't raked, but other people with raked games have the cops at their beck and call to raid those that won't play ball? Effed up!

Can’t be proven but it sure smells that way. The crazy thing is that the person I know is back to running games again. How F..ked up is that?
 
If there's a warrant, you can prove who signed it and why. I imagine there would have to be mention of how the authorization was determined.

If I were you, I would retain a lawyer and (as much as it would be satisfying doing otherwise) limit your discussions of the facts/circumstances/status/etc. regarding the situation to your lawyer and your wife (spousal privilege).

Why would anyone play in a home game with a rake when theres so many other options without rakes???? Is adding an extra 5/10 bucks to a buy in to cover food costs etc considered a rake? (I'm kind of curious what fine print they could have here)

Technically the extra $5/$10 for food could be considered a form of rake. I always provide a nice spread for my players when I host and I do accept TIPS if my players want to give them.
TIPS are never required but I greatly appreciate it when my profitable players for the evening leave them.
