My recollection is that if an oil change place fails to put in oil, that they would be on the hook for the prorated value of the engine, not the full replacement value.
Also, to @doublebooyah85 point, who knows if the engine would have failed at the same moment with you driving as with the dealer. It was a problem engine in a problem car.
I think that $5,300 is a good start. Remind them of sales tax on the replacement, the fact that you might not be able to buy a comparable car for the money, and you might get $6,000 to $6,500 for it, and call it a day.

Wow! Catching up on a long thread! Don’t have too much more to offer, and would go with Option B. Take the cash and get something more reliable. Both my wife and I have Toyotas, and I would never own anything other than Toyota/Lexus or Honda/Acura.
My wife had a Hyundai when we met, and owned it into the first years of our marriage. She didn’t drive a lot, so never got over 100K miles, but did get out of warranty (over 10 years). After the 10 years, all sorts of problems came up, the best being the gas gauge no longer working. She was pregnant with our 1st and no longer felt comfortable with her driving it around, plus the idea of hauling our child in it. Got rid of it, and never looked back. Would never own a Hyundai again.

Hopefully this ends up working out getting some value for (what’s left of) the car and finding something else. It definitely sucks to kind of be forced into looking a little earlier, but at least it didn’t blow up while you were driving or anything like that.

This is the most important part and @doublebooyah85 gave good advice on the terminology to use to try to make sure he’s getting that.
One other point, and I discuss it a lot with people. When you counter an offer; two distinct things happen:
- you reject the original offer; and
- you sent out a new offer
The other party has no obligation to accept your offer, and you will not necessarily be able to go back to the original offer. However, in the case of the car dealership / manufacturer, they will likely work with an individual on a close counter. I expect that OP will safely get to $6,000 with a little skill.

ANYWAYS. Yes BUT I am discussing this with two separate entities:
-Offer is from Hyundai capital H, big company that wants me to sign away claims. Hyundai Motor America. They do not account for dealership error, they don't sell cars directly to me, they want me gone. I don't think I have much wiggle room here and I could talk my way out of that $5,000. This is the easiest option and almost definitely what I'll choose.
- I assume when you talk about counter-offering, that would be with the dealership itself. I can consider that but it would probably be towards a new car, where I'm then entering into a new contract with them. This is where the big wiggle room is at, and something I am considering. No way am I beating $5,500 KBB value with straight cash but I assume I could get another few thousand if I'm shaking on a new car. I need a new car and they know that; if they offer some good faith money for the blown engine it could lead them to making more money off me. We'll see. They sell cars that aren't Hyundais so I am considiering. I have a number in mind and I'll mention that my wife needs a car too.

Two cars before that: Saleswoman got me to give a price I was willing to pay, went in back, and then came out and shook my hand with a big smile on her face like she got me the price I wanted. That was not the case, and apparently she only did that to make me feel I'd "shook on" the deal before I even knew what it was. Not nearly as bad, and the sale and the car worked out, but sleazy sales bullshit disgusts me.
Three cars before that: Salesman* sold me an unsafe lemon with a cracked exhaust manifold, a sunroof leak that turned the car into a pond every time it rained, and something else wrong with the damn thing that would cause it to bang like a tin drum every time it was wet outside. I'm talking terrifyingly loud, every couple seconds, enough to give you a heart attack, every time moisture touched the underside. And the radiator was busted. The salesman not only verbally misrepresented it to the extreme but also affixed a fake recent inspection sticker from the place down the street. After I got the radiator fixed, I let my girlfriend at the time pick up her aunt from the airport and warned her to watch the temp gauge. She ignored it. Car overheated so badly on her way back that it seized as soon as she got to the parking lot.
I haven't even had that many cars, but I've had a negative experience of some kind with every single dealership I've dealt with. Always something. I guess I should be grateful that the woman in the top case didn't actually try to rip me off, just engaged in a stupid cheap trick, but how hard is it to just be honest and forthright?

But that's what I'm saying, its two different entities. Dealers will certainly work that way, huge corporate entities for an out-of-warranty car they haven't looked at yet, I am not so sure. My "insisting" may lead to them scrutinizing and seeing its got peeling paint, no radio, and a spot in the back where a raccoon gave birth.

After reading a little more closely, I find it surprising that they are offering you damn near book value without a fight.
Of course there's a case to be made that you got duped into the "cleaning" thing they made you pay $1,300 for and saw absolutely no benefit from, which IMO they should also compensate you for. Otherwise they're really just comping you $3,700 if you think about it.

The dealer followed the process outlined by the manufacture. Throttle body cleaning, if problems persist, engine replacement. And that’s exactly what they did and he’s getting a replacement value in check. I could argue he’s actually not owed the $ for the throttle body cleaning tbh…the dealer had to pay their mechanic, rent, equipment and such to perform such service that yielded a favorable resolution for the customer.

Meh, I had a working car and no longer have working car. If I'm happy with the KBB yes but priorities are different. I have a really busy two weeks, I'd prefer to just have a working car with some extra oil. You assume they did everything right and it broke anyways, I don't give them that grace.
Incredibly helpful perspective and I'm pretty happy with the resolution, I just don't give them the benefit of the doubt. Brought working car in, they did a service, now car no longer works. I'd be hard pressed to ask someone to pay for that service.
What did you bring car in for?

To begin an oil consumption test. They said before they could do that test, they required an expensive cleaning because it was required, then they'd start the test. I never got to what I wanted to test.
take the KBB option, learn the hard lesson, walk the fuck away, and buy a toyota. this is not lawyer money.
Why were you getting an oil consumption test? (Playing dumb here but getting my point).
I said I could argue, not necessarily what I would do, but the dealer did perform services for you. They have to pay rent, pay for equipment to perform such services, pay the mechanic, pay the advisor, pay for the oil, etc etc etc) and the test yielded your engine is no good and Hyundai gave you full replacement.
Just a counter you should be prepared for and understand if that’s the stance they take. And at that point maybe split it 50/50 if they are being hard pressed to charge you for the test.

Observed accelerated oil consumption, I had read it was a Hyundai drawback. Did not notice any driving issues or changes, just had to stay on top of it and check it while I filled the car.

Not being a contrarian, I’d honestly be over the moon. They could easily, easily provide no recompense and charge me for the service.
What, I’m gonna sue over $5k? Leave a bad review on a dealership with 2k positive reviews and 300 negative ones and hope for some impact?
They have ALL the cards. I must be a dick because I’ve never been treated this well by a dealer.
I’m gonna convince them that while I have two cars with 300k+ total miles and one just blew up, that if they just hook me up Im a large potential buyer?
If it was a horrible dealer, seems like hero would be effed with pretty much no good options. Seems like they’re being stand up folks.
Not to mention, it seems like the car, known or not, was likely headed for trouble. I can’t imagine the headaches and difficulties this causes over the next two weeks, but you literally might have been out the car anyways sometime in the near future with $0 to show for it (and the additional aspect of this happening to a family member going 80 down a highway).
Timing is shit, but I’m a bit confused how this isn’t pretty great luck in the mid and long term (and you’ve already been saving!). Gl on interviews!

1. Yes, you're definitely a dick. That's established.
2. Its not the dealer offering anything, its Hyundai. Different offers and structures. This is part of a larger settlement they've agreed to for these engines, they're not being pals.
3. I am happy with the offer, I am considering asking the dealership for more if I choose to buy a new car, standard. Not saying I'll sue.
4. Yes, situation could be worse, but I'm assessing the situation I am in. Other perspectives in the thread have been very helpful and I'm learning, that's why I asked.
5. Be confused all you want, I don't like shopping for another car and spending lots of money. Happy for the money (if/when I get it), but I'm not excited about juggling another plate.

Let me try that route instead. Congrats on getting lucky and pulling 5k out of thin air on an over 150k mile car because oh no the engine was bad, didn't even make it to 200k miles - while simultaneously holding out that the other car holds it together.

I’ve been in your almost exact situation. I’ve been through a plethora of cars.
I’m not that old and my first car was under $1k, a Ford Taurus as old as I was. Now my circumstances are different.
Extenuating circumstances aside, which provides pretty shitty timing for you, this seems like quite literally the best possible thing that could’ve happened fiscally speaking.
Like sure, in a perfect world they clean whatever and get you what you need paperwork/replacement wise and you drive another 30k miles before you run into the next issue causing you to dump money in. But like…damn if you actually get that payout this seems super……lucky? Positive?
Without knowing how recalls and issues and shit works, like wow. A faulty engine gets you 150k+ miles and then they pay you? Shit, I’d be lining up for the exact same car again
