How does one get permission to use the Tangiers Casino name on some original designed labels? By original design I mean not infringing on either the movie artwork or the fantastic work of the late great Sal from old west?
I don't know the particulars, but Gene @ABC tried valiantly to obtain rights or permissions to all of Sal's OWPS designs and was unable to do so for legal reasons.
Just using the name 'Tangiers Casino' with your own original artwork shouldn't be a problem though, but I'm not a lawyer or copyright expert. @Hornet@pltrgyst
- Copyright protection does not extend to a fictional product displayed in a movie.
- There is no US trademark, dead or alive, for anything even remotely resembling a "Tangiers Casino". Even if there were, trademark infringement is evaluated based on the "likelihood of confusion", and there is nothing protected that your chips could be confused with.
- IMO, if you just avoid any similar artwork that you know exists, you should have no concerns.
I designed a Tangiers label for my custom cash set, went with Hotel & Casino. I don't plan on selling, producing or marketing them so didn't read too much into copyrighting. But as said above, if you change it 'just' enough all should be well.
