The Poker Store is actively selling my cards mold design on the front page of their website. It’s unclear if they obtained the design from PCF as I had posted a fairly high res mock-up well before a cards mold manufacturer ever received my AI file. Or if the cards mold manufacturer is offering it to The Poker Store. I should maybe trace it back because the timing is so close I am not sure if it could have been from the cards mold manufacturer. Regardless, I think it is good to mention this stuff. Retailers should know and care about the products they are selling.

I think it’s a situation where they give TPS the “examples,” and give them the option what to list for an example. I agree that they should do more due diligence, but I think the fact that the image is for a “custom ceramic poker chips” listing supports this. Alibaba probably sent a bunch of samples and TPS picked this one to put on the website. This may be nitpicking, but they’re not “offering your design” per se, they’re just saying “here’s what we can do”

I agree it’s shitty, but a failure to do due diligence does not necessarily mean intent to steal. I doubt TPS even knew that you ordered/made those chips.

Generally this is what I think would happen. And honestly, none of this is very surprising. IP isn’t respected highly in China and we all know this. We shouldn’t be shocked hen we go there for dirt cheap stuff and designs get appropriated. The Alibaba sellers post photos of the chips they have made as sort of portfolio work or past work examples. It isn’t even clear if they are or would sell those designs to other people. But in this instance it is a graphic of my design with “your logo here”, so it certainly looks like you can use my chip designs if you want. I am not outraged or anything. Another PCFer emailed them on my behalf and they said “prove it and we will take it down”. I haven’t bothered with the issue further. It’s not really worth my time.

Like I said, the timing is very tight in this instance. I had posted the design here many months before an Alibaba seller got my AI file and I believe I was notified just a couple days later that it was on The Poker Store site. I need to go back and look at the timing.

Anyway, I think it’s still good to discuss this stuff. If someone absolutely wants their designs and IP respected they should avoid these Chinese sellers.

This, 100%. Can’t have it both ways: the Aria knockoffs were made through these vendors because they were willing to reproduce a major casino’s IP. No one should be surprised then if/when they use your personal designs.

FWIW I just checked and someone notified me that the design was on The Poker Store 14 days after I sent the AI file to the cards mold manufacturer. I would have no way of knowing when it was first listed on The Poker Store site. But it had been posted here to PCF several months before that. So... who knows.
 
I think this copying of designs can be extended to a general discussion about artwork copying overall on this site. There are so many instances of individuals blatantly copying casino inlays, movie images, etc, etc. Granted, these are usually for just personal use but there are companies that are benefiting by printing these.

Also, as pointed out earlier by @ekricket, Apache blatantly copied Matsui's rack design. Not sure if a poker chip rack design is protected by any laws or anything. But it's a bit much to complain about someone copying a design and doing the same exact thing.
 
I modified the design of the rack. Racks are not a money maker for my company or Matsui. You can even say BG too as they sell the same style rack.
Also, I sold them to members here at my cost.

This copycat modified your plaque design as well.

Regardless if money is made or not, designs have been copied. In your other thread, you said you sent a Matsui rack to a manufacturer and asked them to copy it.

I have mad respect for you. You're an OG vendor from the poker boom days. But what you're complaining about is not a unique event with respect to what you've copied and what some members have copied. Almost status quo.
