I've never seen this in a live game, and I don't get to play Scarney as much as other games, but am introducing it to a group that hasn't played this particular strain of degen before, so, I want to have a solution of our does pop up... what do you do if the top board gets killed? What do you do in the highly unlikely, but, completely possible situation where the top board completely goes away?
 
I’m definitely not a Scarney expert, but I’d imagine it’s still split hi & lo based on what players have in their hands
 
1 - You've played this enough!
2 - Invite a guy who knows the game. I know a guy
3 - You are used to playing a variant of Scarney called 'Canadian Murder Scarney' or 'Canadian Scarney with a Kill', Normal Scarney doesn't have 'Kill'. The cards on the top board don't go to the discards in the base version.
4 - If the top board runs out of cards, you simply play the best poker hand you can create using the cards from your hand and the board, so just your hand
5 - Still lowest pips and best poker hand you can make with as many cards as you have

You'll find 2 additional cards in the deck are support cards from Scarney. 'I am the Canadian' is used if you run out of cards, some folk baulk at a player with no cards doesn't have a hand. So they can hold it to mark they are out of cards.

The versions are American, if you run out of cards you CAN bet your hand. They say no one does excess in excess like Americans... Canadian allows you to run out of cards and still call bets, but you CAN NOT bet your hand, 'Sorwy'. Icelandic is FUCK YOU, you ran out of cards take it on the chin you don't have a hand to claim any part of the pot.

High hand still wins. Sounds like you are playing murder scarney. You could play the std version where the bottom board does not kill the top board.
 
Follow-up question for the experts…(assuming best hand in the mitt is accurate)

What if the situation the OP described happens, and I have exactly 4 cards: four-of-a-kind. Does that still play even though I don’t have a “5 card hand”?
 
Follow up question, I've only played the kill version, so what is the bottom board for of they're is no kill?

Top board isn’t necessary to make a hand even if bottom board kills it bc it’s not a holdem or Omaha hand. You can use any of your hole cards and top board to make a hand. If top board is killed you still have hole cards to make a hand
 
After some further research I think I have an understanding of this game now. My confusion was with the term Kill. I was under the assumption that kill meant the dead cards in your hand, when in reality (if I have this right) Kill means a version of the game where the top board cards that match the bottom board cards become dead, thereby moved to the bottom board. Is this correct? I'm a little slow, at times.
