Seller told me he already sold orange chips by a pm. I believe I won both by being first post in thread. If that is how this for sale thread and seller works I am out and someone else can have the yellow chips. Good luck guys.

I am sorry to hear that, MIke... That's a bummer for sure.

In my opinion, the option the seller always has to just say "I sold them through PM" is a very bad thing for our community and there is no reason it should be like that.

When a WTS ad comes up, what should happen is that ONLY POSTS IN THE THREAD ARE VALID AND BINDING. That doesn't mean a seller can't sell chips thought PM, just do not post a WTS ad open to everyone. Now, once the ad is out, and if there is no one BIN-ing the chips, then the seller has the option to cancel the ad if he wants to sell privately. If there is a BIN in the thread, that should be IT!

Given the site rules, technically, no, you're not at fault. And I am not saying you are... In fact, even if you had not received any PM and just decided to reneg MIke's BIN you wouldn't be at fault either, which IMO is preposterous.

All I am saying is that the rules should be changed to avoid scams and people undercutting other buyers behind the scene, that is not good for anyone. I am a big proponent of stricter rules for our classified. It protects everyone, including you when you are on the other side of the deal.

Most ads operate under the assumption that anyone who posts dibs within the thread will have dibs on buying the chips. While this is not clearly written it is kind of just a norm.

It is worth noting that not everyone runs their ads this way. I have posted first in several ads and didn't get the chips or a PM explaining what happened.

I just assume that the seller can sell to whoever they want.

EDIT: in the future I will probably put a disclaimer in my ads saying "I reserve the right to sell to whoever I want and this is not necessarily a dibs sale" to avoid people getting salty if they post first and don't get the chips.

You can be absolutely sure I won't be getting remotely close to any of your WTS ads then. And I can say the same about many here with a little bit of common sense..
 
Maybe you're not "at fault", but you are going to be perceived by many to be someone lacking in ethics, with whom we should not do business.

No I'm going to vouch for the seller here, as I've bought from him before. Stand up guy and I PMed him within a minute of the ad going up asking for the orange chips. Good person to buy from, definitely not lacking in "ethics"

And that's more of a reason to have different rules, Josh: to avoid the gray area and taking a good person/seller for a reneger. For each case of a pair of good buyer/seller (like you and the seller here), there is another case of people doing shady things behind the scene. The clearer things are, the better for good people like yourself and the seller.

Honoring “dibs” is a courtesy of the seller, and not a right that anyone should expect to be entitled to.

In this particular case, some people here have been trashing a seller who offered great chips at a great price, and who did absolutely nothing wrong. wtf?
