Can we already use permanently closed casino chips' designs without getting patent infringement? (1 Viewer)

Grettings PCFers!

This question becomes important in my case, where I thought about hosting a poker game and livestreaming it. I am looking at poker chip designs and I really like The Mirage and The Aria. Of course, The Aria still exists and The Mirage has been closed recently. Can I therefore order The Mirage, tribute poker chips, and stream games where they'll be used?
Will Hard Rock Cafe mail me and tell me that I'm misusing the brand they purchased of The Mirage?

Probably not, but they could. Most poker streams dont do very well; if you strike gold and gain some attention, you really should have your own recognizable brand instead of worrying about the legality of the chips.

Yes, I believe you about both statements. I would rather do a DnD stream or similar games of that nature, and even then, I can see why it wouldn't do that well because DnD and those games are tons of imagination and make believe, not actual graphics shown for a lot of things

I like DnD too but it loses some of the fun once you start recording.

Best of luck but I think your instincts are correct, avoid this shortcut and just make your own.
 
Indeed! I'm not a graphic designer and liked some designs that come from closed casinos or other PCFers themselves!!

There are a plethora of designers on PCF that could help you with your own chips. I’m not a designer, but @mattross1313 has helped me with three sets and they’ve all turned out stellar.

I agree that, if you’re going to go this route, it’s better to have your own chips.
 
Lots of good advice here, but your concern should be trademark infringement, not patents.

I was about to say that the casino might be closed, but the corporate entity that owned those properties might still hold the trademarks on names and logos.
 
Very expensive to do poker streams right. You'll need RFID cards+readers or hole card cams at the very least.
 
This. In the case of a large casino, it is almost guaranteed that someone still owns this crap. Better not to risk it.
Until they curtail chinas propensity to copy anything I’m not going to worry a lot about it.
Everything’s too big now - not enough police, judges, or lawyers to litigate everything.

I’m pretty sure you can’t selectively prosecute trademark infringement - you either shut EVERYONE down as soon as it’s seen or you end up tacitly give approval for anyone to use it.

Make the customs if you start a stream. Better to promote yourself then a old casino.
